Legal Question in Criminal Law in California

16yr old going to group home

my daughter was arrest July 2006 for tresspassing in a public mall in santa barbara tried and dispostioned and sent to santa monica probation and the case was closed Oct 2007. They then sent us a letter July 5, 2007 to go to cort and they tried and dispotion her again for the same case tresspassing in a public mall in July 2006 and put her on probation. She left LA last month so the probation officer put out a warrent for her arrest and she was arrested in San Fransico tuesday and is now back in LA and is going to be sent to a group home. How do I get her home with her family and stop them from dragging us in court over and over for the same thing. Should I be talking to the probation officer who keeps calling.

No, you should be talking to the defense attorney who represented your daughter at trial.

I am surprised that you are not considering hiring an attorney. This is simply not something for you to try.

Good Luck

She deals with the problem by defending against the charges with all appropriate facts and law, using appropriate pleadings and procedures. If she isn't capable of doing it herself, then hire an attorney if you can afford one, or ask for a PD if you can't. Based upon your allegations, she has defenses to it. Feel free to contact me if serious about getting her private counsel.
