Legal Question in Criminal Law in California
My 24yr old son was arrested for making a very bad judgement call, He's never been arreseted, no criminal background, has held a steady job since he was in the eleventh grade. He has a very good job now and works hard long hours with only one day off a week. Recently he moved into his own apt.
In Riverside. While he was home with me for two months working here in Long Beach, Ca on a temporary assignment. When it was time for him to return to riverside to his normal job, when he went home his apt. had been broken into. He made a very bad judgement call and because he thought he knew who did it he approched them with a couple of his friends that just only took him home. They all were arrested for home invasion, robbery of the first degree and assault with a weapon. There was no home invasion, no robbery but there was a weapon. Should he be sentenced to 3-5 years in prison, or are there other options?

Sentenced? He hasn't pled guilty or been convicted yet, has he? If not, he might still have options, the most obvious of which is retaining a private lawyer.
There are always options, one of which would be to get your son Probation. There would need to be a complete discussion of the facts with an attorney in your area. Good luck to you.
What he 'should be' sentenced to will be determined by a negotiated plea bargain or by the judge after a conviction at trial. Depending upon the actual charges brought, he faces at least several years in prison if convicted. Idle speculation based on no facts is of no value to you or him. An informed legal opinion would have to be based upon all the facts, evidence, rap sheet, defenses, etc. If he is serious about hiring counsel to give him an honest opinion and to defend him, feel free to contact me.
