Legal Question in Criminal Law in California

appeal in court

i have a brother who is serving a sentence in Delano state prison. He had his first appeal and was denied. I need advice in searching for a lawyer who specializes in appeals for criminal law.

After the first level appeal you've already done, you're going to spend a great deal of money with very little likelihood of success. This isn't TV, appeals are only won by a showing of legal or factual errors made by the judge.

Your brother needs an expert in criminal appellate practice. Most criminal attorneys' expertise is limited to the trial courts.

The State Bar of California certifies specialists in several areas of the law, including appellate practice. There are about 240 certified appellate specialists in the state, many (perhaps most) of whom handle only civil cases. You can find these attorneys at the bar's website, though I don't think the site's listings distinguish the ones who handle criminal appeals from the ones who do not. I am among those who handle criminal cases and you should feel free to contact me if you want to discuss your brother's case further.

I should add that there are many excellent criminal appellate lawyers in the state who are not certified. I don't know of a systematic way to find them, but you may be able to get referrals from other lawyers who know them.
