Legal Question in Criminal Law in California

I want to apply for my real estate license and I am very concerned about a misdemeanor petty theft I was convicted of back in 1998. I did get the case expunged in 2002 but I know I have to disclose it but am still concerned over how it may effect the licensing process. Is there anything else I should do to ensure my guarantees of being granted a real estate license?

The DRE may very well deny you a license on this basis. You may want to have a lawyer help you draft your application. You should also be prepared for a potentially long and costly battle with the DRE. That might not happen in your case, but I have dealt with the DRE in a similar case and found them to be quite unreasonable.

Records are forever, and you have to disclose all convictions on your application, expunged or not. It is then up to DRE to determine if you are disqualified from licensing. Money crimes will generally do so. The only thing you can do is try to overcome it with evidence of changed life, etc.
