Legal Question in Criminal Law in California
I was in an argument with my brothers girlfriend, and some heavy name calling and verbal insults were exchanged. She ended up pushing me up against a wall and striking the top/side of my head a few time. So I went outside of the house and called the cops. She took off and came back before the cops arrived.
When they did I told them my side, and they took her outside to talk to her. They came in and said She admitted to not striking me but pushing me, and said I had pushed her back. Which I did but it was to get her off me.
We both pressed charges, and were booked for battery on a person. We were site released after a long day in jail. We have a court date coming up.
I wanted to know, if she admits to even just pushing me, am I at risk for being punished for battery? Also she has moved in (about 4 days a week) about 8 weeks ago, so I don't think it is a legal residence. Can I get a restraining order put on her? What advice do you have about the court date?
