Legal Question in Criminal Law in California
i was arrested back in 1990 in a mistaken identity family dispute. anyhow i was arrested and booked in jail on christmas eve stayed in jail 3 days and was released, never charged never convicted. almost 25 years later i am trying to see my nephew on a cps case but because the arrest came up i explain but to no avail..

The only remedy available is to hire an attorney to prepare and file a Petition in that local court, seeking a court finding and order of 'factual innocence' and ordering correction and/or destruction of the arrest record.
