You probably can't. I might be able to.
There are a lot of variables for there to be a somewhat intelligent, and appropriate answer. I would have to know several factors that I don't know now....like....what was taken? What was the value of the merchandise and how many items are we talking about ? How old are you ? Any prior record ? What store ? What area ? These and other questions need to be answered before I can give you any type of intelligent reply. Call me at my office at 661-2671313 and we can go over all the facts. I look forward to speaking with you.....David Wallin
CAN the case end up being reduced or dropped? Sure. Is that likely, just because you want it? No. The police and DA don't spend time and money arresting, charging and prosecuting cases only to drop them without a fight, and a reason to do so.
Effective plea-bargaining can help your situation. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney that does, who will try to get a dismissal, diversion program, reduction, or other decent outcome through plea bargain, or take it to trial if appropriate.
If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help, using whatever defenses there may be.
