Legal Question in Criminal Law in California
how can I avoid prison time for first time shoplifting, less than $50?

Since it isn't a felony punishable by prison time, you don't face any.
You do face potential jail up to 6 - 12 months on the misdemeanor.
However, your attorney should be able to get a first time offender with no prior criminal record a 'deal' that minimizes or avoids jail, and MAYBE even avoids a conviction on their record, through 'diversion' programs. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
You are not facing prison time...but it's not prison time that you should be concerned about....You should be concerned about the CONVICTION. If you are convicted of a theft charge, jobs will be few and far between in your future. As a Former Deputy District Attorney, we have helped 100's of people in your situation resolve cases like yours with reductions of the charges to a NON-THEFT RELATED offense, or a dismissal of all charges. No attorney can guarantee a result, but you should retain a highly qualified attorney or law firm to attempt to resolve your matter in the best possible way for your future.
