Legal Question in Criminal Law in California
I was in the back of a pick up truck and we got pulled over. The driver was under the influence and so was the passenger. I was the only sober one. As I sat in tihe back of patrol car I noticed sheriff found something in the back of truck. Passenger quickly asked me to take the blame for it. Even HER needles. Shes a felon. I felt bad for her so me like a dummy took blame. The sheriff came searched my house...AND DIDN'T FIND ANYTHING! I had my husbands money in my purse, inside my car....and they took it. Even after I told them the money was legit. I don't use drugs is all I kept saying. And he didn't find drugs on me. Why did he go to my house AFTER and take my stuff.Someone help please.

"Why" is irrelevant to ask. When arrested and charged with any crime, the proper questions are, can you be convicted, and what can you do? Defend the charges. Go to court, enter a not guilty plea, arrange bail reduction or O.R., set up and attend the court hearing[s] and trial date[s]. File evidence suppression or other motions as applicable. Raise all the available defenses with whatever admissible and credible witnesses, evidence and facts are available for legal arguments for motions, plea-bargaining, or at trial. Go to trial if it can't be resolved with motions or a plea bargain. There is no magic wand to wave and make it all disappear. If you don't know how to do these things, then hire an attorney that does, who will try to get a dismissal, diversion, reduction or other decent outcome through plea bargain for you, or take it to trial.
