I have been on probation for 2 yrs my case will be dismissed in may 17, 2004, if I dont have any new cases. I got a DWAI but pleaded not guilty, if the DA in California does a back ground check will that come up or am i ok until I go to trial and they find me guilty? I have been reciding in Colorado now for 2 years,

Thank you for your posting.
As you might expect when filing cases, the DA's office normally would run a "rap sheet" on you, to find out if you have priors or are on probation, and may notify or file a probation violation if you are and pick up a new case.
It's best to get an attorney to handle the more severe consequences of having a prior, and the probation violation.

If you were on probation when you got the new charge, you could face probation violation. Yes, the DA will find it automatically, and it will be factored into the outcome.
