Legal Question in Criminal Law in California

bail bond reimebursment

I paid someones bail in full. What are the procedures I do to get bail reimbursed? Can I get it back before the cases is over? Do I need a lawyer in order to get it? The case is taking longer than I expected, I need it now, the lawyer envolved says he's too busy right now-says he'll do it next court date --l end of June. Is there something I can do before then?

If you deposited with the court the full amount of the bail, you can get the bail exonerated and returned. The time for the return is about 4-6 weeks. To get the bail exonerated you would withdraw the bail, and the person would be put in jail, or the court could release him on OR. If you paid a bailbond company you will not get any money back.

IF he goes to every court hearing and complies with all court orders, and thus does not have the bail forfeited, and IF the court does not use it to pay any fines upon sentencing, you will get it returned a couple months after the case is closed. You should ensure he makes all appearances, and you should be there to protect your investment, especially at sentencing hearings. Alternatively, you could try to make him post replacement bond thru a bail bondsman, thus releasing your bail. If he screws up, you lose the money.
