Legal Question in Criminal Law in California

How does bail work?

My son paid a bail bondsman $2,500 to

be released from jail on a charge of

intent to sell 1/4 ounce of marijuana.

Assuming he appears in court, is he

supposed to get any of the $2,500

back?

Re: How does bail work?

sorry no - you will not get money back from the bondsman. Looks like the bondsman charged you 10 percent premium/fee on a 25K bond. The fee stays with the bondsman - that is how he makes his money. Alternative always is to pay the full cash collateral if one has that kind of money. The upside is you get it all back when the case is over.

Re: How does bail work?

No; that was his cost to avoid posting the entire bail amount.

Re: How does bail work?

No. Bail premuims paid to bondsmen are non-refundable fees. Had you posted the entire bail yourself (probably $25,000.00, based upon $2,500.00 being 10%, the standard fee), that amount would be returned about three weeks after the case.

This will likely be written very clearly in the bail contract.
