Legal Question in Criminal Law in California
I bailed my wife out of jail and she went to court and the case was dismissed so i stopped paying the bail( whitch is in my name only) can the bailbonds men take her back to jail for me not paying the bail

No The bail company can't take her to jail, as there is no case, and therefore, there is no jail left without a criminal case pending. However, the bail company can take you to court and sue you civilly for the money you legally owe them. They performed a service and you should pay them for that service. If the bail company took collateral , they can also go after the collateral. I'm sure the bail company will take payments, if you can't pay what you contracted to pay in a given time period.
I agree with Mr. Wallin. She couldn't got back to jail for your failure to pay the bailbondsman even if there was a case pending. Your failure to pay is a civil issue between you and the bailbondsman.
