Thank you for your inquiry, and I am sorry to hear about your situation.

You truly should seek legal counsel to assist you. A battery charge, even as a misdemeanor, is a violent crime, and can cause you repercussions in the future that may be avoidable with a good defense attorney on your side.

Otherwise, the crime you've been cited with has a minimum ($100, no jail, and probation), and a maximum, $1,000 in fines, plus a penalty assessment of over $2,000, depending on the county where this occurred, probation, a stay away, or restraining order, and up to one year in jail. A sentencing judge, at arraignment, or after trial, has discretion to sentence anywhere in this range. More importantly, however, the DA can negotiate with a prepared defense attorney to get this charge reduced to something else that may not have the same consequences as a PC 242.

I hope that this informiaton helps, but if you have further questions, want more information, or feel that you need legal representation, please contact me at [email protected]. I am happy to help in any way that I can.

The max penalty is 6 months and $1000 fine [multiplied by penalty assessments totalling twice the fine approx]. You should consider hiring an attorney, who should be able to make the best defense with your facts, and negotiate a 'deal' much lower than the max penalty. Contact me if interested.
