Legal Question in Criminal Law in California

Getting Blackmailed on a supposed rape

I have a very strange situation indeed. I took a girl out dinner on saturday and we had a good time. She then kept on insisting that we should go back to my place and get drinks. I didn't feel comfortable but we ended up back at my place. We drank heavily during this time period. I remember that she kept asking me for money and items. I guess she thought that I had money. I am so tired and drunk that I need to go to sleep. I wanted to sleep in another room but she consistantly asked for me to lay in the bed with her. I passed out. The next morning she told me that I had supposively raped her. She told me that all I had to do was buy her a plane ticket to fix the problem. I did. Now she wants me to pay off her student loans and pay for some therapy and pay for moving expenses which adds up to over $10k. What legal recourse do I have? What is my best route to go?

Thank you for your question, and for the opportunity to both help and advise you further.

I must agree with my colleague that you need legal help, and fast. This situation could get worse if you don't give into her demands, but it also can get much worse even if you do give into her demands, which you already have. It's likely that she can make a claim that she was raped to the police or prosecutors, or sue you civilly for a large amount of money. Either way, having an attorney represent your interests and be your point of contact for her is your best choice at this stage.

I hope this helps, but if you have additional information, have other questions, or would like legal representation, please feel free to email me directly at [email protected]. It's my pleasure to help you in any way that I can, and thanks again.

ONce in such situation, you should get good legal help, to either scare her off, or properly defend her claims if she does bring them. The longer you wait, and the more you agree to her demands, the worse it gets for you. She could file criminal charges or civil suit. Feel free to contact me if you want legal help in this. You have defenses.
