Legal Question in Criminal Law in California

Boyfriend(on probation)put in jail over a crime I commited without his knowledge

A raid took place at a house where my boyfriend sometimes stays. He wasn't at the residence during raid, I was. I had placed some meth in his wallet(without his knowledge) and locked it in a locked box in the room he stays in sometimes. During the raid, the police, at first, charged me with possession. At my arraignment they only chgd me with paraphenelia and put out a felony warrant on him because it was in his wallet and he is on probation for drugs. They took him into custody at the probation office and also are chging him with another felony, pc1203.2, rearrest/revoke probation. I am fully responsible for this and want to confess asap. He really was and is completely innocent of these charges. How do I even go about making a confession and getting him released? I'm beside myself with guilt and have no problem confessing that it was mine. Im scared that they won't believe me and will still charge him anyway. Can a private attorney get him released and me charged with the crime? Then what happens from there? An innocent man is in jail because of my actions. I cannot live with myself knowing its my fault. Please help, time is of the essence.

You need to talk to a private attorney. Do not go to the police except on an attorney's advice (which you probably will not receive). You could make matters worse, they could charge both of you and not let him go.

Yes, they probably won't believe you, and will charge him. IF you confess and plea guilty to the possession, and accept sentencing on the charges, they may be willing to dismiss charges against him as part of the plea bargain. It will have to include his potential probation violation as well. If you are interested in having private counsel help you negotiate the plea and try to minimize the jail time that will go along with it, contact me.
