Legal Question in Criminal Law in California
my brother used my name as an alias when he went to jail.now every time i have a background check.my name comes back with his extensive criminal record i have gone to Court to see if i can get this fixed but they seem be of no help.

Casually chatting with a clerk at the court is not going to accomplish anything, if that is what you tried. You will have to take legal action seeking a court order to correct and update your records, then use that order as part of a process with DOJ/FBI.
