Legal Question in Criminal Law in California

My brother was arrested for 5 felonies regarding fireworks. He was in the car, and had no knowledge of the fireworks or the drivers intent to sell them. Can they charge him since it wasnt his car. What should he do and what can I do? Does this mean he has 3 strikes?

Your brother needs to get a lawyer. If he cannot afford a lawyer, he should ask for appointment of the public defender.

Can they? Well, they did, didn't they? Whether he can be convicted depends upon all the facts, evidence, witnesses, etc., and the legal and factual arguments his attorney can make in motions and at trial if necessary. He definitely needs an attorney when facing felony charges that, by definition, could put him in prison and give him 'strikes'. If this is in SoCal, have him contact me if serious about doing so.
