Legal Question in Criminal Law in California

my brother is being falsely accused of a lewd act with a minor the sheriffs detective and child services told me that my son was a victim and lead me to believe he was a victim for the past two months i only found out he was not a victim until a few days ago when my brothers lawer told me is this legal? they also told me they would take my kids from me if i didnt put them in counseling and said my mother should find another place to reside until the case is over or they would take my kids from me ?

Your brothers claim of 'falsely accused' is what he'll base his defense on, and his lawyer telling you the charges aren't true, doesn't make him right.

Yes, you could lose your children if you don't protect them. Whether social services can take them under these circumstances is debatable, but if you ignore the warnings, you'll get to deal with their lose after the fact.
