Legal Question in Criminal Law in California
My brother is on parole every time he leaves the police bring him back to search the house. he uses drugs and that is the only thing he has been in trouble for. he dont sale or deal.my question is if he does not have anything on him when they search him can they bring him back to search the house.

Parole means a waiver of search and seizure rights. They can do so anytime they see him.

Probably, since most parole terms, include a search of the parolee's home and person, without a warrant and without the need for probable cause.
