Calif Civil Shoplifting Law

My daughter was cited for shoplifting 39 dollars of merchandise at Sears. Her court date is july 8 2008. Today I got a demand for payment from a law coorporation for 375 dollars. Is this legal? She has not even been to court and the letter doesn't say I will be free from liability if I do pay. ANy help is appreciated

I would not do anything until your daughter's case is resolved. She should be able to do a diversion/class program which will not result in a conviction or in the worst case scenario plea to an infraction.

even if you pay you still risk arrest and charges of shoplifting. It happens quite frequently. If that happens, it will definitely be on your record. Before agreeing to anything, you should consult with counsel and have them represent you in dealing with the company. Feel free to contact me if serious about doing so.
