Legal Question in Criminal Law in California
If a case that you were denied severence from gets dismissed and the man convicted wrongly gets exonerated, does that mean that if you are still doing time on the conviction the case that is now dismissed becomes irrelevant and we have to evidence to go back to court with such new information.
1 Answer from Attorneys
If you are saying you are serving time after being convicted, then if you have grounds for appeal or motion based upon newly discovered evidence applicable to your case, you can try to file and pursue those claims. Just because another defendant is exonerated or wins, does not mean you would, nor does it mean that is 'new evidence' for you. Each defendant fights his own case.
