Certificate of Rehabilitation/Felony Expungement
When my boyfriend was 18, he was hanging with the wrong group of friends. He was charged armed robbery and served 1 yr state prison boot camp. After getting out on parole, he changed his life. He on the Honor Society, on the Dean's List, and Grade Pt 3.7. He would like to get a job as an engineer in the aerospace field but they do a security clearance. Will a expungement help? What are some alternatives to help him seal his record or how do we go about in cleaning his record so that he will be able to get a job? Its been almost 9yrs and he is about to graduate.

When applying for a federal government security clearance, you have to put the offense down on the form even if it was "expunged." But in your case, applying for a "certificate of pardon and rehabilitation," available after 5 years of nonoffending after completion of parole, could help him a lot - consult an attorney. The security clearance authorities are supposed to look at the "whole person" and take into account the good as well as the bad. But let's face it, armed robbery is a biggie. No expungement is available to him under CA law. He can try for a certificate of rehabilitation, but either way, he has to disclose the conviction on any government agency or licensing or job applications. Then, it is up to the agency or employer to decide whether to hire. It will be difficult for him to get any security clearance, but not impossible.
