I think that any attorney who tried to give an opinion based on these brief facts would be committing legal malpractice.

You need a lawyer who can review all of the evidence and give you an informed answer. If you can't afford to hire one, you're entitled to an attorney at government expense and the judge will appoint the Public Defender to represent you.

I think the police have some other type of evidence -- maybe the testimony of an informant, plus fingerprint evidence -- to use against you. Telling us what evidence the police don't have is not enough to get an informed opinion back from us. You need to find out what evidence they *do* have. If you haven't found that out already, you will at your prelim.

Get a lawyer if you don't already have one. This is not something you should try to handle on your own.

Good luck.

I 'think' you've been charged with a felony, and I 'think' you may not know and understand all the facts and evidence. Police and DA's don't file charges unless they are convinced they can convict, otherwise they would be wasting their time. You're facing prison time upon conviction, so suggest you hire an attorney to defend you. If this is in SoCal, and if you're serious about doing so, feel free to contact me.
