Legal Question in Criminal Law in California
Possible Charge of Terrorism?!!
My friend tried to return a puppy to a pet shop because of physical defects. When they refused, my friend became upset and began arguing with the pet shop employees.
They called police and claimed that my friend became violent and threatened them
They also claimed she threw the puppy at them!
The police arrived and handcuffed her and sprayed pepper spray in her face twice.
After being detained for 3 days she was released.
Her trial is set for 3/21/07.
Her charges include Assault, Resisting Arrest and Commiting a Terrorist Act !!?
Is there anything that can be done for her?

Re: Possible Charge of Terrorism?!!
Sure. Defend by properly presenting what witnesses, facts and evidence she has. By now there has already been a pre-trial conference where an offer was made by the prosecutor. Apparently, she didn't take the deal offered. Now she gets to go to trial. If she isn't comfortable conducting the pretrial proceedings, and the trial, up against the experienced prosecuting attorney, then she needs an attorney to represent her. I'll be happy to help her. If she is serious about getting counsel, have her contact me to discuss the facts and costs of defense.
Re: Possible Charge of Terrorism?!!
She needs a lawyer, and if she can't afford one the court will appoint one for her at public expense.
Hopefully what is scheduled for March 21 is her arraignment, not her trial. That is when she should request a public defender if she can't afford counsel.
If her trial is coming up and she has no lawyer, then either she could have hired one but didn't or she refused an appointed lawyer. Either way, if she has decided to forego counsel she made a bad choice.
