Legal Question in Criminal Law in California

Can i be charged if i am caught stealing or breaking into an illegal marajuana grow house.I know nobody lives there but can i be charged with a breaking and entering , home invasion or residential burgulary,.ect

Yes. A crime is a crime, even if the victim is a criminal, too.

I wouldn't be so certain that the house doesn't fit the definition of a residence, either. Even occasional use as sleeping quarters is enough to support residential burglary charges.

Finally, getting prosecuted might be the least of your problems. The government might send you to prison, but the illegal growers might kill you.

Duh. Burglary is a crime, no matter what. In addition, you face execution by the residents. I wouldn't take that risk lightly. They are already criminals. What is to stop them from killing you and disposing of the body?
