Legal Question in Criminal Law in California

I was charged with section 4060 (possess controlled substance without prescription). Which was a pill in my purse. I do have a prescription for it but i have no idea what pill it was that they found. How do I OR who do I contact to identify the drug it is that they charged me with? That way I can bring the correct prescription with me to court to prove it was mine. It does not say anything about what pill it was anywhere.

After your first court appearance, your lawyer will get the police reports, which will have specific details about the pill that was found in your purse. You should provide the prescription and any other relevant information to your lawyer.

If you can't afford to hire your own lawyer, the judge will appoint one from the Public Defender's office when you go to court.

I agree with Mr. Marshall. At the arraignment, the prosecutor usually turns over a copy of a police report, which usually identifies the controlled substance.

IF you have a valid prescription for the pill, or any pills, you could bring them 'all' to court and try to convince the DA and judge that they apply to what was found. You may be able to try that at your arraignment, once you obtain the police and lab reports, if they are available yet at your arraignment. If not, you'll have to set a Pre-Trial date in order to discuss this with the DA. Most people would hire an attorney to make sure they got the best outcome possible.
