Legal Question in Criminal Law in California

I am being charged with a shoplifting charge from Sacks. First offense. I had a baby three weeks ago, have been diagnosed with bi-polar, and depression. If I get a note from by doctor what is the probability of getting the charge dismissed. This was in Orange County, CA.

In my experience, the Orange County DA won't dismiss your case because you present medical documents like you describe. With an otherwise clean record, however, an attorney may be able to use them to negotiate with the DA on your behalf to avoid a conviction. The specific facts of the case and the medical information need to be discussed more fully though.

Sympathy 'defenses' are not likely to get you a dismissal. They might allow your attorney to get a decent plea bargain that avoid a conviction, or might work with a jury at trial. If serious about getting proper legal help with this, feel free to contact me.
