Can I be charged with theft if i was seen on video taking something from a store but wasn't caught at the time

I agree with Mr. Wallin, but either the store or the police will have to ID you from the video.

Yes. When there is evidence that somebody committed a crime, the fact that he wasn't arrested at the time does not entitle him to get away with it.
