Legal Question in Criminal Law in California

charges on domestic abuse

When I was arrested for domestic abuse my wife didn't press charges. She was told it is automatic. How does this work. Can she drop this, is there anything we can do to make this go away. I am in school and would like to be an attorney and I will have no future with 2 felonies. We have been married for 8 years and never have had an issue.

This is a difficult process. It is unfortunate. Depending on the situation there is some hope, but I would have to talk with you in further detail to really determine where you stand.

I am in San Diego county, and can discuss this at your earliest convenience.

You can't just "make this go away". You need to get a lawyer; with luck, he or she may be able to negotiate a deal you can live with. If that doesn't work, you'll have to go to trial.

Nothing just 'goes away', but if handled right by counsel, it may be possible to negotiate a plea agreement that won't forever damage you. She DID press charges - you were arrested. Once arrested, she can not just 'drop it', the DA's policy is to prosecute even over the objection of the victim -- too many victims are threatened into asking it be dropped. Feel free to contact me if serious about getting the legal help you'll need.
