why are charges listed as misdeamenor but case# is a felony?

My husbands son was taken for child abuse. His son has ADHD and oppositional disorder. He has had a very difficult time with him. There has been no physical abuse, no sexual abuse. They are saying it was cruelety and excessive punishments. We have 4 other kids that were never taken out of our home. We are both in parenting classes, anger management classes and therapy. We are both being charged now with child abuse and conspiricy. Why is the case number a felony but the penal codes a misdemeanor? What are my chances as his stepmother of having to go to jail? I have never been in trouble with the law, have never been accused of anything like this. What about my husband, could he go to jail? Social Services is doing a reunification plan for us.....would they really put us in jail? Or could we possibly get probation? I am really scared for my other kids. Please help me.

You are apparently being charged with felonies, for which jail time is quite likely. You really should get counsel, to help you in this process. Feel free to contact me if you decide to do this right.
