Child Endangerment Law

My brother in law was arrested for a DUI and was charged with Child Endangermant. What are the normal fines for this in the state of CA.

There are the results you get if you hire a lawyer, and then there are the results you get if you don't. If there was a kid in the car probably Your Friend will be DCS bait.

This will depend on whether this is his first DUI. The minimum DUI penalties for a first time DUI are usually a fine, registration in an alchol abuse class, and credit for time served assuming he spent any amount of jail time already following his arrest.

However, since there was a child in the car, a sentencing enhancement is available meaning he could be headed back to jail.

The child endangerment charge actually is a separate charge that carries its own penalties.

First time DUI offense carries with it approximately $1500 in fines, alcohol program for 3 months and loss of license for at least 30 days. Child endangerment is a separate crime punishable by county jail if it is charged as a misdemeanor, or even state prison if a felony, not to mention an additional fine.

You need to understand that the child endangerment offense in combination with a DUI constitute serious charges and amount of the fine is probably the least of your concerns. Your brother in law needs a good lawyer asap.
