Legal Question in Criminal Law in California
My child got talked into stealing an Ipad from school with 2 other boys. He has adhd, ptsd and depression (clinically diagnosed). The other two boys returned the ipads they had but the one my child had was stolen from him when he was on his way to school to return it? The school is aware of his conditions. Can he be held or can we be prosecuted for this? He has been continually bullied and has had failing grades since he started in august. It took me 3 months to get a meeting with all teachers to get a 504 in place. they changed meeting date so i looked like a no show and basically said it wasn't adhd he chose to not do his work and offered no help. Had a second meeting with the VP and she was trying to help. He thought if he took the ipad the other boys would say something and it would stop the bullying. what can we do school police have been to my house and I have sent him to his moms until i can figure out what to do. He is terrified.

If theft can be proven, then prosecution is quite possible. Sounds like he already 'admitted' to it, with an 'explanation'.
