Legal Question in Criminal Law in California

CHP misconduct

I was arrested for a DUI on Sunday morning. I was then assualted a couple of different times while in transport the the county jail. After arriving at the county jail, I was refused medical attention. After release I went to the emergency room and was treated for my injuries. I can give more information if this is your field. Thanks for your time!

Re: CHP misconduct

Your version of the story will be quite different from the officer's, who will likely say you were resisting arrest and assaulting an officer. Your attorney will have to deal with defending you with that background.

Re: CHP misconduct

Right now you have to think about not just the misconduct, but the DUI. You need an attorney for both. You are welcome to give my office a call, if you would like to discuss this in more depth.

Re: CHP misconduct

What happened to you is not unusual. You dealt with the type of police behavior which, unfortunately, is far too common.

For your purposes, you need to separate two things. One is defending your DUI case to which, unfortunately, the police behavior is largely irrelevant. Get a good lawyer is my main advice. Suing the CHP in a civil or administrative proceeding is quite another matter although I would not discourage you from looking into it.
