Legal Question in Criminal Law in California

citizens arrest

I was place under citizens arrest for misdemeanor battery. I was not booked, only given a citation to appear in court. I plead no contest and the judge reduced the battery to an infraction disturbing the peace. I am applying for a job that asks if I was ever charged or convicted of a misdemeanor. My question is: Do I need to answer yes to being charged with a misdemeanor.

You are obligated to truthfully say you were convicted of an infraction, the original charges are not the issue. If you want to expunge even that conviction from your records so that you don't even have to disclose it, an attorney can help you file the proper motion and applications. Contact me if interested.
