Legal Question in Criminal Law in California

Clearing Background Checks

I have two convictions (86 & 89) Buglary and vandalism which have barred me from employement with ab FDIC banking opportunity. The bank will move forward if I am able to clear them off my background check. Is espunging possible? How can I clear these from my record to secure employment?

Re: Clearing Background Checks

Expungement should do the trick. You can do it yourself - by filing the forms - or you can hire an attorney. You might have problems expunging the 86 convictions because of the one in 89. If your convictions qualify, make sure to reduce to misdemeanors BEFORE expungement.

Re: Clearing Background Checks

You may be able to expunge them so that they show as 'dismissed' retroactively, but for any employment with the government, banks, schools, hospitals, jobs with professional licenses, background checks, security clearances, bonding, etc., you'll have to disclose the conviction and expungement. I can't say whether bank rules will allow you employment after expungment, listen to what they tell you, but if you are eligible for expungment by having successfully completed all terms of probation, you should try for it so that you can say 'no' to conviction on most private employment applications. Feel free to contact me if serious about doing this.

Re: Clearing Background Checks

I am not so sure if your request is to teach you how to clear the record so that you wont have to pay an attorney or to expunge your record as your attorney.

If your answer is yes, you want an attorney, yes I can accomplish your goal.

Sincerely

Allen
