Legal Question in Criminal Law in California

I was a co-defendant to a case back in 2002. I really had nothing to do with the situation, I guess I was at the wrong place at the wrong time. I was booked into county jail and was there for about 2 weeks or so, until court date. The public defender told me that it would be easy for me, since I had no criminal background and I would plea guilty, be released that day with a misdemeanor and only get 3 years probation. Fast forward to 4 years ago, I needed to get a live scan to work at a daycare. What came back on my report did not match what the public defender told me. I called the courthouse and they no longer have record because it has been more than 10 years. Fast forward another 4 years, I am trying to become a notary public and a Covered CA counselor, as well as a DMV rep and I need to get live scans for all 3 jobs, will this affect me? What can I do to get rid of this?

You can seek to have the misdemeanor case expunged, which would allow you to deny that you were convicted of it for the Covered CA job and the DMV rep job. But you'd still have to admit it for the notary public application because it is a state or local licensing (one of the few exceptions to the expungement law). If you'd like to discuss this further, call me at 310 922 3983. Good luck. Steve Mandell
