Legal Question in Criminal Law in California
I'm a college student, and I recently got a call from my brother telling me my father is in jail and this is what I found online.
11357(B) M H&S POSS MARIJ 28.5 GM L W/P
496(A) F PC RECEIVNG STOLEN PROP
11364 M H&S PARAPHERNALIA
11377(A) F H&S POSS CONTR SUBS
1203.2 F PC VIOLATION OF PROBATION
I would really apreciate if someone could tell me what all this means and how bad is it.
Thank you
1 Answer from Attorneys
What it means is that he faces prison / jail time for various drug charges, receiving stolen property, and potential return to prison or jail for probation violation on his earlier conviction.
What can he do? Defend the charges. Go to court, enter a not guilty plea if appropriate, arrange bail reduction or OR, set up and attend the court hearing[s] and trial date[s]. File motions as applicable. Raise all the available defenses with whatever admissible and credible witnesses, evidence and facts are available for legal arguments for motions, plea bargaining or at trial. Go to trial if it can't be resolved with motions or a plea bargain. There is no magic wand to wave and make it all disappear. If you don't know how to do these things, then hire an attorney that does, who will try to get a decent plea bargain for you. If serious about doing so, and if he is in SoCal courts, feel free to contact me.
