Legal Question in Criminal Law in California

concern for a child

Is it legal for a male that is going to be nineteen in August to date a female that just turned sixteen in January? and are her parents breaking any laws by allowing this?

he says it's o.k. as long as they don't catch him having sex with her. Is this true?

It's OK as long as they don't *actually* have any sort of sexual contact -- not just as long as they don't get caught. A crime is a crime whether the criminal is caught or not. And the young man should remember that it is often possible to prove something happened even when no one saw it happening.

Yeah, sure, that's the right answer: anything is ok if you don't get caught.
