Legal Question in Criminal Law in California

consensual intimacy between a 20 year old and a 15 year old

I am 20, male, and in California. I have a consensual, reciprocative relationship (of both a friendly and romantic nature) with a 15 year old female in Wisconsin. She is still legally under the care of her parents. We have NOT met in person as of this date, but engage in romantic behaviors through the internet and phone (ie romantic conversations, shared masturbation, etc). (Consensuality is well documented.) Her parents have forbid her to have any contact with me for other reasons, and know she feels she is in love with me (they do not know the full of my feelings, but I have made clear our intention to eventually date). Am I at risk of a restraining order or charges of child molestation? If we were to meet in person, what activities would bring additional risk of such charges, and/or a conviction regarding such charges if they were filed?

Aside from the fact that she is an FBI agent working for Dateline NBC, you don't even have to do it to become a felon and have to register for life as a sex offender and never work again after you get out of prison. Just enticing a minor over the internet is enough. If it's true love she'll wait.

What? are you an IDIOT? Aren't there enough 18-and-overs for you in CA? Exercise a little judgment; you're not a kid anymore! Get off the computer and join the living.

I wouldn't suggest you add to your problems by meeting in person until she is 18. You've already committed a series of state and federal felonies, that could bring prison time and registered sex offender status. It's a funny thing, prosecutors don't think much of adults doing the things you describe. If the girl's parents file charges, you'd better get a good attorney, real quick. Feel free to contact if and when that happens.

See perverted-justice.com and Dateline NBC's "To Catch A Predator" series online or this Friday at 8. To put it mildly, your past actions and what you are contemplating in the future are not brilliant.

If you make the unwise choice to follow through, you'll need a good lawyer, and I'll be happy to represent you, but I, or anyone else, will be able to do little to help at that time. Minors are incapable of consensual intimacy. Your whole premise is legally incorrect.
