Consensual Sex
My son will be turning 18 soon, if he and his under 18 girlfriend are have consensual sex can he be charged with statutory rape?

My understanding (someone correct me if I'm wrong) is that if there is less than a 3-year age difference, it would be charged as a misdemeanor, not a felony.
