Legal Question in Criminal Law in California

conspiracy drug juristriction laws

I am in court right now judge is waiting 4 an answer! I live in la county & ventura county detectives had a wire tap on my friends cell phone, I am being charged w/conspiring to distribute in ventura county but have never been here! I need to know the laws of juristriction on this matter fast pleaze! thank u

Your question is actually about venue, not jurisdiction. Every state court in California has jurisdiction over the case; the question is which of those courts should actually handle it. The answer is most likely the court where the alleged crime occurred. If the offense itself was in Ventura County and you participated by phone from L.A., you can properly be tried for it in Ventura.

Now get a lawyer -- you're going to need one.

Jurisdiction is something which your lawyer should be able to argue about. The prosecution will try to prosecute you on the theory that the potential fake buyer contacted you from Ventura County and that's why Ventura should have jurisdiction, regardless of where you were located. This is not necessarily a crystal clear issue and your attorney should look into it immediately. Jurisdiction of the court can be attacked at either arraignment or preliminary hearing. If you can continue the arraignment date, you should do so.

Teaching everything you would need to know would take quite some time. Learning and using effectively in compliance with court rules on procedure and evidence and motions will take yet more. Suggest you seek a continuance and hire experienced counsel that knows what to do, if you want to stay out of prison. If you can't afford private counsel, request the public defender.
