consumer bill dispute
My wife received a large cell phone bill in Sept 07. We called COMCAST to settle the bill and the tech told us the bill/acct did not exist. The tech could not locate our account by name, acct #, address, etc. We called the second time and got the same result of the tech telling us the account could not be located and that there was nothing he could do. We have his name and service ID. We had not heard anything else from COMCAST since Sept 07. But we received a notice from a collection agency last week saying that the bill is due and we have now pay. Is this legal, since two techs at COMCAST told us they could not find the account and as such could not accept payment since ''their system'' said the account did not exist? This seems unfair since we maid honest attempts to settle the bill beforehand. The techs are legal representatives of COMCAST and said the account no longer existed. That should be binding, correct? I saved the name of the tech we spoke with on the phone. Do I have any legal footing to tell the collection agency that I am not legally obligated to pay a bill? We had not heard anything from COMCAST concerning an overdue debt.

If you had a cell phone and got normal billing, then this will get straightened out with the phone company by determining what the accurate billing is.
If you never had a phone or billing, and this is some kind of mistake, then that too will get straightened out with a showing of the mistake. Since you haven't been able to resolve it yourself, try having an attorney do so.
