I was convicted of a 1st time dui in May 2010.

How can I shorten my probation period? I would like to join the military and they will not accept me if I am on probation.

You can request early termination of probation. It sounds like you have a great excuse to get off of it. Judges normally don't like to release people from probation early unless they have a good excuse. You can then apply for a dismissal of your charge.

You can seek to have your probation terminated early under Penal Code section 1203.4. You must show "good cause" as to why you want to have your probation ended. You must have completed all obligations (alcohol school, fines paid, etc.).

DUIs have additional consequences (a zero tolerance for alcohol and driving while on probation, for example) that make them political and the courts are less likely to grant an early termination than on other type cases.

If you have complied with all conditions of probation - fine, classes etc you may be in luck. Was your grant of probation 3 years? (as it is in many courts) Or five years? (as it can be here in some San Diego courts.) If it was 3, you may be about half-way into it ... many courts will allow counsel to terminate probation early if they can document that alone is keeping the client out of a job, the military etc. At the same time the attorney may be able to expunge the conviction.
