Legal Question in Criminal Law in California

Coupons

During his job at a big retail store he noticed that people who bought merchandise using coupons were being paid the full value of the merchandise plus cash the value of the coupon upon return of the merchandise.

He brought this to his supervisor's notice but nothing was done to fix the problem.

My son got tempted and he also started buying things using coupons then returned them getting full cash value of the coupons. He did that when he was off duty.

One day he was off duty when he got called by the store to work because someone had called in sick. When he got to the store he was taken to the interrogation room and confronted with the video tapes of him buying and then returning the merchandise. He accepted the fact that yes he was buying and returning stuff in order to get cash value of those coupons and yes it was morally wrong to do it but the system allowed him to do so and it was not illegal. He was asked to sign the statement that he gave and was assured that the statement was meant only for internal audit. Later he was arrested and handed over to the police. This happened 2 years ago. Now DA has charged him with misdemeanor on 8 counts. Originally he had charged him with felony
