Legal Question in Criminal Law in California

Criminal background

I would like to know how to go about getting my felony of over 20 years expunged or get a letter of rehabilition. Because I have a class A CDL and can't get a job because of the old felony.

Re: Criminal background

Your ability to have your case expunged depends on whether or not you served prison (not jail) time on the felony case. If you did not do prison time, you should apply for an expungement in the courthouse where you had the case. You can contact the clerk's office in that courthouse for the Expungement Petition and/or the Public Defender's Office for assisatnce.

If you did prison time you are not eligible for an expungement and should apply for a Certificate of Rehabilitation. For this, you should contact the Public Defender's Office where you had your case. There is no cost to apply for a Certificate and the Public Defender's Office should have an attorney to assist you.

Re: Criminal background

You may be able to expunge it IF it wasn't for domestic violence or sexual based charges, and if there was no prison time served or ordered as part of sentencing, and if you successfully completed all terms of probation, and if you've had no further convictions. If you think you qualify, feel free to contact me for the legal help you'll need.
