criminal case

an altercation occured with a neighbor and my boyfriend. He threatened him and it turned physical and now the police are trying to contact him. what should i do?????

Tell BF not to talk to the police, period. He should ask for a lawyer if he is detained, and if arrested he should get one. He should view the YouTube video "Don't Talk To Cops."

Criminal threats (Penal Code section 422) can be filed as either a felony or a misdemeanor. As a felony, it is also a strike under California's three strikes law.

I agree with the other attorneys that have posted here - there's nothing he can say to the Huntington Beach PD that will help his situation. Your boyfriend really should speak with a criminal defense attorney.

If the police are trying to contact your boyfriend, he should not talk to anyone without having an attorney present. The police will try all kinds of tricks to make him talk. Keep in mind that they are not his friends. Their goal will be to use anything they can to build their case against him and to incriminate him.

Getting a lawyer involved is also a good idea in case the police have already made up their minds that they want to arrest him. A lawyer could negotiate bail and surrender issues upfront and spare him an unpleasant and unannounced arrest.

Run and hide for the rest of his life; OR, hire an attorney to defend the criminal charges they are bringing and trying to arrest him on. Feel free to contact me if serious about doing so. Free advice: Tell him to exercise his 5th Amendment right to SHUT UP and speak to no one but his attorney.
