Legal Question in Criminal Law in California

criminal record

In 2001, I was arrested for drug paraphernalia. Had an opportunity to go to a drug program but at the time, I literally was being terrorized by a horrible man. I was abusing meth and quit a great job at UCSD. Yes, I made some really stupid choices.

After being arrested I tried to end that very abusive relationship (was only in the relationship for less than five months) but was having a difficult time getting rid of the guy. Its a long story, but finally I got a restraining order and had the guy arrested. He only did two years prison. Out of fear of this guy, I sold my house and moved.

Finally I have my life back. Recently Ive applied for a few jobs and didnt even get an interview. On the job applications, I admit having a misdemean thinking it is best to be honest. I believe that this blemish on my record is preventing me from getting a good job. I have MA degree and feel that I wont ever be able to get another good job. I have never been in any kind of trouble before all this happened and I havent been in trouble since.

Can I get this off my record?

Re: criminal record

Yes, you should be able to expunge the record if you have satisfactorily completed all terms of probation. Feel free to contact me for the legal help you'll need in filing the Motion and Application.

Re: criminal record

You can apply to have your conviction expunged. Based upon what you have written, chances are that your application would be granted. It is much better to have a lawyer do this for you than to try to do it yourself; unless there is something unusual about your case, the fees for such a service should be modest.

Good luck.

Re: criminal record

There is something called "expungement" of your conviction which will legally enable and entitle you to say on any job application that you have never been convicted. This is something you can do yourself by contacting the court where your conviction took place and requesting the necessary forms, or retain an attorney to do it for you.

Very best,
