DA Dismissals
what is the protocol for someone who plead no contest to a misdeamenor and was given a Arbuckle waiver sent to do a PC 1000 Drug diversion program. on 5-19-03 Completed drug diversion on 6-7-04. How do i get this off my FBI Clearence?
it shows up with a background check and on the docket minutes it states per court/DA dismiss complaint/ct#1
Diversion terminated passed
criminal proceedings dismissed
Doesnt this mean that it should not show up on my criminal background done by the DOJ Dept.
I am going to school for my BA in Criminal justice and am intending to pursue a law degree.
I also have a Felony back in 1990 that had a harvey waiver to it and i was told that i could have it esponged after completing the terms of my plea agreement how do i go about this when i leave in NEw York now and not California where these crimes where committied.

You need to hire local counsel to handle the motions, pleadings and appearances necessarty.
Sorry, these will remain on your record, expungement simply means it can't be used against you in court after the dismissal and expungement, and you can tell civilian employers "NO" to conviction. You have to disclose the history to any government or licensing agency on applications.
No guarantee of expunging felonies, it is discretionary with the judge.
