Legal Question in Criminal Law in California

My daughter recently started cosmotology school, loves it and is on the honor roll. Recently there have been two fires in the bathroom of this school and the school called the police who viewed vidio of students coming and going from the bathroom. The officer showed my daughter a video of her walking into the restroom and told her that 20 minutes after she used the restroom a fire started, and tried to get her to confess. My daughter did not start the fire and did not confess and yet the officer said she was going to submit my daughter's statement to the DA and see if he wants to file charges. My daughter has never had as much as a traffic ticket, but the police refuse to speak with us and do does the school. Do we have any recourse?

Recourse, probably not. But, she should look into hiring some sort of counsel. The mere fact that she is looking at arson charges is a very serious charge. If charged with Arson, she is llooking at 16 - 36 months in state prison.

Do I think that someone with no criminal past would get state prison time, probably not. However, the charges are very serious.

Your daughter needs an attorney immediately. If anyone tries to question your daughter again, she needs have an attorney present. Your daughter is probably innocent but unfortunately, she might have to prove it.

Do you? No.

However, as to her, she needs to understand that when threatened [which she is], arrested or charged with any crime, you need to hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense, other than the advice [if not already too late] to exercise the 5th Amendment right to SHUT UP and do NOT talk to police or ANYONE about the case except an attorney. That includes on this or any other web site or public forum. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation.
